1. Acknowledgment of Risks
Participant acknowledges and agrees that horseback riding, horse handling, and all related activities are inherently dangerous and involve risks including, but not limited to: falling from a horse, being bitten, kicked, stepped on, or thrown, collisions, slipping, equipment failure, weather-related hazards, uneven terrain, and unpredictable behavior of horses. These risks may result in serious injury, permanent disability, or death.
2. Assumption of Risks
Participant voluntarily assumes all risks associated with participation in horseback riding lessons or any equine-related activities conducted by or at Nirvana Equestrian / KMK Partners, LLC, whether on horseback or on the ground, including risks arising from the actions of the Participant, other participants, spectators, animals, or third parties.
3. Release and Waiver
Participant, on behalf of themselves, their heirs, assigns, executors, and personal representatives, waives and releases the Released Parties from all claims or liabilities arising from personal injury, property damage, negligence (except gross negligence), emotional distress, loss of income, or medical expenses that may occur as a result of participation.
4. Indemnification
Participant agrees to indemnify and hold harmless the Released Parties from any claim, lawsuit, demand, liability, costs, or expenses (including reasonable attorney's fees) arising out of or related to Participant's participation in any equine-related activities.
5. New York Equine Activity Warning
Under New York State Law (NY GOL §18-301), equine professionals are not liable for inherent risks of equine activities.
6. Medical Authorization
Participant authorizes Nirvana Equestrian / KMK Partners, LLC staff to obtain emergency medical care if needed. Participant agrees to be financially responsible for all costs associated with medical treatment, transportation, or related care.
7. Behavior & Barn Rules
Participant agrees to follow all safety rules and barn policies, including wearing appropriate footwear and helmets when required, using respectful conduct around horses and staff, and acknowledging that failure to follow safety rules may result in removal from the premises without refund.
8 Severability
If any portion of this Agreement is found unenforceable, the remaining provisions shall remain valid and enforceable.
